Terms of Use for the Job Market search API for labour market training and coaching
Parties and roles
Interface owner = The KEHA Centre.
Interface user = An organisation that commissions the interface technically.
The interface user can be any organisation that wants to display labour market training and coaching that have been published at the Job Market in their own online services.
Conditions for use that are binding on the parties
The following Terms of Use (“Terms of Use”) govern the use of the Job Market Finland service platform and the search interface for labour market training and coaching included in it (“Interface”) produced by the KEHA-Centre (“Service Provider”). The organisation commissioning the interface (“Interface User”) must read these Terms of Use.
Both the Interface User and the Service Provider commit to comply with these Terms of Use.
The purpose of these Terms of Use is to guide and commit the Interface Users to use the Interface in accordance with the terms set by the Service Provider and with Finnish legislation and requirements issued by the authorities. The parties are committed to operate in an ethical manner and in accordance with good conduct and applicable legislation.
1. Service Provider’s rights and liabilities
After receiving the commissioning notification and reviewing it, the Service Provider must provide the Interface User with the appropriate user IDs by secure mail. In this message, the Service Providers must also deliver the technical description and instructions of the Interface to the Interface User.
The Service Provider must endeavour to keep the Job Market Finland service platform and the Interface in 24/7 operation but cannot be responsible for the operability of the system, interruptions caused by technical errors and maintenance or installation work, data communications disturbances, or for any alteration or loss of information or other similar data due to these reasons.
The Service Provider is not responsible for any costs caused to the Interface User by possible defects in the Interface.
The Service Provider has the right to temporarily interrupt the use of the Interface if it is necessary due to, for example, technical changes or updates. The Service Provider informs the designated contact persons of any downtime as soon as it is known. The Service Provider is entitled to provide the Interface as it sees fit and to alter its content.
In addition, the Service Provider has the right to temporarily prevent Interface use in a fault situation. After questioning the Interface User, the Service Provider has the right to terminate the Interface User's access right either permanently or for a fixed term if necessary.
2. Interface User's rights and liabilities
In their own systems, the Interface User is responsible for implementing the technical requirements concerning the Interface and for the operability and compatibility of the required hardware and software with Job Market Finland.
The Interface User is responsible for all personal costs arising from the use of the Interface.
Other services that display labour market training and coaching through the search interface must always include the original source of the postings (Source: Job Market Finland customer information system).
The Interface User is entitled to display labour market training or coaching in their own services through the search interface and to use them as information content in their service. Therefore, this allows the Interface User to combine information received through the interface with other information, whether self-produced or acquired from another source. Information retrieved through the Interface may not be presented in a manner that is contrary to good practice, inappropriate, or harmful. Neither may the Interface User use the information in a manner that causes its services to be confused with the public authority’s service.
Labour market training or coaching, when displayed through the Interface, may not be handed over to third parties without express permission.
The Interface User commits to ensure up-to-date labour market training and coaching information in its own service. Removed labour market training or coaching must reflect on the User’s service immediately, nor is it allowed to store removed labour market training or coaching in a way that remains searchable.
Material retrieved through the Interface may not be used to advertise or market a software application or service that is based on the material without the permission of the KEHA Centre.
Either Interface User has the right to terminate their use of the Interface at any time by unilateral announcement. These announcements must be sent to tmt-koulutustietorajapinta@keha-keskus.fi.
3. Technical requirements
The technical usage requirements of the Interface are provided in separate search API instructions.
4. Data security, data protection and processing of personal data
The Service Provider must arrange the Job Market Finland service platform's and the Interface's data security in compliance with common good practices and strive to prevent unauthorised access to their information systems by means of appropriate technical and administrative measures. The Interface User is aware of the fact that the data security of the online environment and e-service can never be perfect.

The Interface User is obliged to protect the identification data required for the use of the Interface.
5. Interface Users' register data and their use
The Interface User must provide the necessary information required for using the Interface. The Interface User's personal data is stored in Job Market Finland's contact information register for stakeholder cooperation. The Service Provider processes the Interface User’s personal data in accordance with the register’s Privacy Statement and applicable privacy legislation.

6. Changing the Terms of Use
These Terms of Use can be updated by the Service Provider, and the Interface Users will be notified of any changes, which they approve by continuing to use the Interface. Changes to these Terms of Use will take effect according to the schedule given by the Service Provider.
7. Appeal
Decisions made by the Service Provider, which affect the Interface User, can be appealed as stipulated in the Administrative Procedure Act (434/2003).
The Service Provider can make the following decisions that affect the Interface User:
- Refusing the commissioning of the Interface. The Service Provider must provide the justifications for the decision to the person who submitted the Interface commissioning notification.
- Temporarily restricting the use of the Interface due to an infringement of these Terms of Use.
- Temporarily preventing the use of the Interface due to a significant violation of these Terms of Use.
- Permanently preventing the use of the Interface due to a significant and continuous violation of these Terms of Use. If the use of the Interface is permanently prevented, the Interface User will be allowed to reapply for the right to use the Interface by submitting a new commissioning notification within six (6) months of the decision.
A decision under point 2 can be implemented immediately, if doing so is necessary to safeguard public trust in Job Market Finland or to stop clear abuses. In such a situation, the Service Provider must immediately contact the Interface User to rectify the situation and clear up the matter.
An appeal can be submitted to the Service Provider either electronically or by post.

The Service Provider must handle the appeals expeditiously and deliver the decision to the concerned party.
If the Interface User rectifies the improper procedure within the appeal period, the rights to use the Interface can be restored before the matter is decided.
8. Applicable legislation
Operation of the Interface must comply with Finnish legislation and the binding instructions given by Finnish authorities.
