Resignation
Ending your employment may be a relevant option for you if, for example, you want to change your job, are looking for new challenges, or are moving to another location. You can end your employment relationship with your current employer by resigning or terminating the employment relationship.
If you want to end your permanent employment relationship yourself, this is called resigning. You can resign from your job without giving any special reason. Your employment does not end immediately when you resign. Instead, a notice period begins, during which you must continue working. The notice period is determined by the Employment Contracts Act, but different provisions may apply under the collective agreement for your sector or an agreement between you and your employer. Check the statutory notice periods on the website of the Occupational Safety and Health Administration.
You can also resign from a fixed-term employment relationship.
- You and your employer have the right to terminate a fixed-term employment contract made for a justified reason if you have separately agreed on this either in the employment contract or during the employment relationship.
- You and your employer have the right to terminate a fixed-term employment contract made without a justified reason if the employment relationship has lasted for at least six months.
- If you make a fixed-term employment contract with your employer for more than five years, the rules for terminating a permanent employment relationship apply after the employment relationship has lasted for more than five years.
Where possible, it is polite to inform the employer of such a decision in good time. You can announce your resignation with a separate notice of resignation or by sending an email with your name, personal details, and the date.
Termination of employment
If there is a trial period at the start of the employment, you may terminate the employment relationship during this period without giving any special reason. During the trial period, you can terminate the employment relationship without serving any period of notice. In such cases, the employment relationship ends immediately, in practice on the same day.
As an employee, you can also terminate the employment contract if your employer violates or neglects very seriously their own obligations, such as payment of wages or occupational safety
